Next Real Model® TERMS AND CONDITIONS
Entrants:
1. All entrants agree to the terms and conditions of the competition by submitting their information and uploading data to assist their entry.
The Organisers of this competition are deemed Next Real ModelPty Ltd. Sponsors are deemed as any other affiliated company or prize supplier. A full list and contact details will be available at www.nextrealmodel.com.au
2. Entry is available as at midday on the announced date. Entry is open to Australian residents only and all entrants must be aged over 16 years as at the date of entries opening. Any entrant under the age of 18 years must have parental or guardian consent to enter the competition.
Entrants who have performed modelling services for other agencies are eligible to enter; however, contestants who have earned more than $10,000 in modelling fees in any one-year period are ineligible to enter.
Entrants agree that the competition co-ordinators have the right to publish any or all of their uploaded images and video that accompanies their entry. Their name and state will also be published. Any other personal information will remain private under the Organisation's privacy policy
All images and video uploads must not exceed four (4) megabytes in total size. If any files are larger than this maximum size the Competition Co-ordinators can refuse the entry. Photographs must be in colour and taken within 6 months prior to entry. Please make sure the pictures are of good quality. The model must be the only person in the image and the model should be standing against a solid background. Videos are not to be longer than 1 minute.
Limit of one entry per person. Online entrants must be the authorised account holder of the e- mail account from which the entry is made.
Any entrant who uploads nudity, offensive material or content will be barred from entering the competition. (refer to the release statement below)
3. Organisers assume no responsibility for lost, illegible, incomplete, unconfirmed, damaged, late or misdirected entrant forms, all of which will be void, or internet technical, hardware, software, failures of any kind which may limit a person's ability to enter the contest. All entries must be received by the announced closing date.
4. The finalists will be decided through the online voting process only. The winner will be decided through the voting process and a judging panel who will be present at the announcement event.
5. The ten (10) entrants who receive the highest number of votes via the internet will be deemed finalists and will be required to attend the Sydney event. All finalists will be announced on the website (www.nextrealmodel.com.au) . An email will be sent to all finalists notifying them. An additional email will be sent to all entrants notifying them of the finalists chosen.
Judges will view all entrants and announce two (2) wild card finalists. This will be in addition to the ten (10) mentioned previously.
6. The winner will be announced at an event that will be held at a location and date to be decided. The final winner will be decided by a judging panel of industry representatives who will bear no relation to any of the finalists. Their decision will be final and no correspondence will be entered into. This arrangement may be altered at the discretion of the organisers.
7. Upon entering the competition, all entrants agree to be available to attend the final.
Any entrant under the age of 18 years will require a parent or guardian to accompany them. All entrants over the age of 18 years will be permitted to travel independently.
The Organisation will pay any reasonable travel expenses. Any expenses other than travel and accommodation will be the responsibility of the entrant.
8. The winner's package will include items that are non-transferable or non-redeemable for cash.
9. Employees of contest sponsors and organisers, and their affiliated parent, and subsidiary companies, advertising and promotion agencies, and their respective officers, directors, representatives and agents ("Contest Entities"), entities furnishing prizes or otherwise connected with the conduct of this contest and their immediate families and members of their households, are all ineligible to participate in the contest.
RELEASE
Entry constitutes permission (except where prohibited) for Organiser and Sponsors to use Finalists' names, images and likeness for advertising, promotional, and publicity purposes worldwide without additional compensation and without prior notice for two years following completion of judging.
Participants in this contest hereby waive and release, and agree to hold harmless Organisers and their affiliates, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the contest, or their participation in this contest or any contest or prize related activity, or any travel related to the contest or prize related activity.
Organisers and sponsors are not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from entering or downloading any materials in the sweepstakes.
Organisers and Sponsors reserve the right to cancel or suspend advertising the contest on the internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the promotion. Organisers and Sponsors reserve the right to disqualify any entrant found to be disrupting the operation of the contest or web site.
2010 VOTING TERMS AND CONDITIONSThis will be changed in line with the voting processes used in 2011 1. Next Real Model Voting is the process of registering a vote for your favourite candidate. Eligible votes are to be registered either SMS to 199 111 22 (SMS cost 55c incl. GST) Use of, and/or access to the SMS voting service constitutes the voter's agreement to the Voting Terms and Conditions. Iconic Brands reserve the right to amend the Voting Terms and Conditions at any time. Any difficulty using the SMS voting format can be referred to the local toll free help line 1800 205 596.
2. Next Real Model SMS Voting is open to all mobile subscribers (users) who are connected to the Telstra, Vodafone, Optus, Virgin and 3 mobile digital networks with SMS compatible mobile phones in Australia only. Pre-paid mobile subscribers will need to ensure that they i) have sufficient credit prior to voting and ii) that the mobile plan of their choice provides access to Premium SMS services on the ‘19' telephone prefix. Post paid subscribers will need to ensure that they have access to Premium 19 services.
3. Unless otherwise stated, all timing references are based on Australian Eastern Daylight Savings Time and Australian Eastern Standard Time when it commences in NSW (18 Sept 2010).
4. To cast an SMS vote using the Next Real Model SMS Voting Service, viewers must send an SMS text message from their mobile handset containing the (exact) initials of the candidate and their unique code to the designated phone number.
5. Any SMS votes received after the specified voting period has closed will not be included in the vote tally. Any vote submitted after the SMS voting period closes will be charged at $0.55 (including GST).
6. Under no circumstances (including but not limited to any act or omission on the part of Iconic Brands) will Iconic Brands be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the SMS voting services.
7. Users must ensure that all care is taken when sending messages to the SMS voting services. It is the user's responsibility to ensure that they use the correct number and provide the correct unique vote code to register a valid vote. Next Real Model, Iconic Brands and the voting service provider will not be liable for costs incurred, responses received or any other consequences of user error.
8 The Next Real Model voting service will be available from midnight September 18, 2010 and will continue until midnight October 31st, 2010.
9. Next Real Model and Iconic Brands reserve the right to keep all voting tallies confidential. No results other than what is required for the purpose of the format of the program will be released to the public.
10. Under no circumstance will Next Real Model or Iconic Brands accept any responsibility or liability for costs incurred or any other consequence as a result of a voter submitting a vote prior to or after the voting lines have been announced as opened and/or closed. This also includes, and is not limited to errors made as a result of time differences between time zones in Australia. Next Real Model and Iconic Brands reserve the right to amend the voting times at any stage.
11. Votes registered using the Next Real Model SMS voting service, will be charged at $0.55 (including GST). Pre-paid customers must ensure they have enough credit to cover the cost of each vote registered; only fully paid votes will be deemed valid and counted toward the final tally. Iconic Brands suggest that permission of the mobile phone account holder must be obtained prior to votes being made.
12. Close of voting will be based on the advertised AEDT/AEST (as applicable) and no correspondence will be entered into in relation to late votes.
13. Any SMS votes received after the specified voting period has closed will not be included in the vote tally. Any vote submitted after the SMS voting period closes will be charged at $0.55 (including GST).
14. Under no circumstances (including but not limited to any act or omission on the part of Next Real Model, Iconic Brands and voting service provider) will Next Real Model, Iconic Brands and voting service provider be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the SMS voting services.
15. Except as provided for by the Non-excludable Rights: a) all content for voting Services are provided "as is" and without warranties of any kind, either express or implied, b) Participating mobile telephone carriers and their suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Neither your mobile telephone carrier nor Next Real Model, nor Iconic Brands, or the voting service provider, warrants that access to the SMS voting service will be available, uninterrupted, free from delay or error-free or that any defects will be corrected.
16. In order to cast a valid SMS vote, entrants must submit their entry via a mobile phone with a reply path. The SMS message must have passed through a Telecommunications carrier's network to the database. Automated votes submitted via computer modems, programs or any other means other than a mobile phone as specified above will be deemed invalid.
17. In the absence of block, manipulative, unrepresentative or disproportionate voting patterns one valid SMS number will count as one vote, however Next Real Model and Iconic Brands reserve the right in their sole discretion to disqualify or discount: i. Any votes however cast (or individuals from voting), that tamper with, or attempt to tamper the voting process, or Next Real Model and Iconic Brands' decision in this matter is final and binding, and no correspondence will be entered into.
18. Voters acknowledge that any votes that are discounted invalidated or disqualified in accordance the provisions of point 17 will still be charged at the advertised rate of $0.55 (including GST).
19. The charges for all SMS voting Services will appear on a subscriber's next mobile and/or home telephone bill. All queries relating to mobile and/or home telephone bills should be directed to the mobile or fixed-line telephone carrier.
20. All information, text, audio, material, graphics, software and advertisements contained in or forming the Voting Services ("Content") are the property of and Iconic Brands , its suppliers and/or licensors (including the users telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way unless expressly authorised in writing by Iconic Brands.
21. SMS is not a guaranteed delivery communication tool. Next Real Model, Iconic Brands and voting service provider cannot accept responsibility for any SMS messages not received, any SMS inadvertent reply message or for any delay in the delivery of any SMS message due to technical disruptions, network congestion, network failures or for any other reason. A vote complying with these terms will be included in the tally following delivery into the voting database from the Carriers.
22. At the conclusion of the competition (October 31st 2010) the ten entrants who received the highest number of votes using the SMS voting line will be deemed finalists. An additional two will be added at the discretion of the judges. All decisions are final and no correspondence will be entered into.
